employment law
Good Afternoon: I'm looking for anyone knowledgeable about Employment Law. Here is the situation: My son is 25 years old and works for my brother in the trash business. My brother refuses to pay them by check or take out taxes on his employees. He follows no standard work ethics at all. he also has his 2 sons working for him. They are also mistreated, verbally. My Brother didn't pay taxes on his business for years, more recently, he has made some attempt at making it appear he pays some taxes, but as i stated before, he refuses to pay employee tax. They have never gotten a W2. When my son trys to complain, he is verbally abused, and made to do extra work. My brother knows enough about the law to not fire my son, but working for him is pure hell! Does he have any recourse?
Working in America: How much do you know about your rights?
Did you know that....*Discrimination only applies if you're part of a protected group: race, gender, religion, age (if you're over 40), pregnancy status (in some states), sexuality, and disability. If they're discriminating against you in some other way, chances are it's going to be tough nuggets in court*At Will Employment - In most states this guarantees you the right to quit a job, if you want, without having to provide any type of notice. This also means that (with the exception of a few states) that the employer can also fire you for any reason that they wish at any time they wish... They can fire you for not wearing makeup. They can fire you because they hate blue eyed people.*There's no law that prohibits an employer for firing you from your after work assocations - meaning if they send a memo stating that you will be fired if you are found to have spoken to Mrs. X, they can fire you.*You can be fired for taking a day off of work for medical appointments, even if you come back with a note.*Many states don't have regulations in regards to breaks, lunch breaks, or smoke breaks. Meaning that if you aren't a smoker and you're caught out with the smoker's on...
At Will Employment - What's your opinion?
For our readers in the United States, you may or may not have heard about "At Will" employment. At Will employment was originally intended to protect both non-contract employees and employers in the event should either wish to terminate the employment. However, in most (But NOT all) states this means that an employer can terminate the employment for any reason they desire, as long as the employee doesn't fall into a group of people protected by Equal Opportunity laws. They can terminate you because they don't like your counsin's sister's uncle, or because they don't like it that you don't wear make up - and most states have no legalities that prohibit this.Do you think that At Will employment is a good idea?
Our boss told us not to take coffee breaks anymore
It has been a busy month for all of us here at our office. The clients are getting impatient on us and because of that our boss told us that we should work more and to even use our coffee break time to do more work. I was really angry of what she said. If that was told to you how would you react? What would you do? I'm not following her though because I'm munching on a cookie in my cubicle now.[em]thumbup[/em]
Do you like your boss?
if not, how do you manage?
are you married to your job?
Your boss loves you and saying NO to any work given to you is never an option. Skipping lunch, rushing through dinner, cheating yourself out of hours of sleep has become part of your daily schedule. You miss parties and family functions without batting an eyelid. And always give the same excuse "I'VE GOT WORK". But beware - This is not a sign of a devoted worker but that of a workaholic whose single minded focus negatively impacts other areas of our life like family, health, liesure and friends. Signs of workaholism are - you are too tired, irritable, socially isolated, may suffer from headaches, insomnia, shortness of breath, racing heart, muscle tension, ulcers
We dont want you in here anymore!!
A disabled lady who has been a regular visitor to a good restaurant for a long while has apparently been asked by the management not to use their restaurant again....the reason given is that because she is quite disabled that the other diners are being `put off` off their food having her eating with them!!!! So because she doesnt manage to eat quite as `tidily` as everyone else, which is no fault of her own at all,she has been asked not to return for anymore meals at her favourite restaurant...right or wrong decision by the management??
anyone who knows the law esp. on employment contract, please help.
It happened one and a half years ago when I applied for a job in the company where I am now employed. After the interviewer, who is also the owner of the company, said that I was accepted for the job, he asked me to make a letter(handwritten) stating that I would not leave the company or look for another job until I could serve the company for five years. Of course, he did not force me to write it, but I thought that it was just a mere letter and it was not valid as an employment contract which the company could use against me if ever I would leave before the five years will end. A friend told me that it's already good as a contract. Do you think that letter is as good as an employment contract according to the law? Can the owner hold it against me? Please help!
Work of My Nephew...who do I think I think is more important?
Well, my week old nephew is on his way to the hospital! I am really worried about him, I'm shaking as I'm typing this. So I called my work to see if I could get toight off...I told them my 1 week old nephew is going to the hospital and I wanted to be with him. They're calling someone else right now (i'm waiting for their call) but they said if I do get tonight off and go, I'm going to be written up! I said, "even in an emergency?" and she goes "yep." And if I have to get another nigth off for whatever reason, I'll get fired! I better start looking for a new job because I tend to have a lot of emergencys in my famiyl!
When I first started this job-- there was mold on the wall next to my desk
from a leak by the air conditioner- eventually it was fixed - only after i had an allergic reaction to it one day when it was raining really bad. My boss expected me to be here the next day when the guy came to fix it, after I was weezing and coughing the day before just from the mold and such in the air. Now that its fixed I am still coughing and weezing (although not as bad) but I am not sure what to do - I cannot leave till I find a new job but I need some advise as to what I can do while I'm here to help ease these symptoms...anyone?
